Resumen
El presente trabajo es el resultado de un minucioso y exhaustivo análisis de los diversos criterios emitidos por la Corte Interamericana de Derechos Humanos en relación con la Jurisdicción Contencioso Administrativa.
El objetivo de este estudio es ofrecer a investigadores universitarios y a potenciales litigantes en el Sistema Interamericano o en la jurisdicción interna antes citada, una sistematización de los criterios utilizados por el Tribunal Continental, que permitan conocer la interacción entre ambos tipos de procesos en tres niveles: a- la Jurisdicción Contencioso Administrativa como un recurso del derecho interno que se ha interpuesto y agotado previamente a la tramitación del proceso internacional, b- el impacto de las resoluciones judiciales internas en el trámite del proceso ante la Corte Interamericana, y finalmente, c- los criterios utilizados por dicho tribunal supranacional para revisar la convencionalidad de esta clase de juicios.
This paper presents a detailed, in-depth analysis of the various criteria issued by the Inter-American Court of Human Rights in relation to administrative law litigation. The aim of this study is to provide university researchers and potential litigants in the Inter-American System or the aforementioned domestic law with a systematization of the criteria used by the Continental Court, which allows to reveal the interaction between these two types of procedures at three levels: a- Administrative law litigation as a resource of domestic law that has been pursued and exhausted prior to the international process; b- the impact of domestic judgments in the procedure in the Inter-American Court; and finally, c- the criteria used by said supranational court to review the conventionality of this kinds of judgments.
