La caducidad de la instancia en el proceso contencioso-administrativo: una reflexión en torno a la inactividad procesal y su tratamiento jurisdiccional

Este trabajo trata sobre una temática no regulada expresamente en el Código Procesal Contencioso Administrativo, lo que ha generado una fuerte resistencia en su implementación. Las discusiones jurídicas han gravitado en torno a un problema procesal real, que se presenta en aquellos litigios en los que la desidia, desinterés o abandono de la parte actora o reconventora, hace que procesos judiciales permanezcan largamente en detrimento del servicio público y los derechos de las partes. Se analizarán las diversas propuestas surgidas para atender el problema, entre las cuales se encuentra la que sugiere aplicar supletoriamente la caducidad procedimental prevista en la Ley General de la Administración Pública (Art. 340, Ley N° 6227); así como sus críticas. Asimismo, a partir de lo anterior se abordarán temáticas como: el correcto dimensionamiento del principio de autosuficiencia del Derecho Administrativo; los límites para el proceso contencioso administrativo en la aplicación supletoria de institutos del juicio civil; el impacto del nuevo Código Procesal Civil (Ley N° 9342) en esta materia, e incluso las deficiencias del Código Procesal Contencioso Administrativo del 2008.
The present lines are reviewed by a subject that, because it is not expressly regulated in the Code of Administrative Litigation (Law No. 8508), has found strong resistance in its implementation. Legal discussions have revolved around a real procedural problem, which arises in those disputes where the disdain, disinterest or abandonment of the plaintiff or the comptroller, causes judicial processes to remain paralyzed for a long time, affecting the public service and the other procedural parts’ rights. This investigation will address the different approaches proposed, as well as it’s main critics. Considering the former, it will also reflect on transcendental issues for the Costa Rican administrative contentious process, such as: the correct dimensioning of the principle of self-sufficiency of Administrative Law, the administrative procedure in the supplementary application of civil trial institutes, the great impact of the new Civil Procedure Code on this matter, and even the deficiencies of the Code of Administrative Litigation 2008.
