Abstract
Por motivo de su carácter emergente dentro de los foros académicos, la
conceptualización del Derecho educativo aún presenta ambivalencias
terminológicas que dificultan su comprensión técnica. En ocasiones, se
utilizan los términos Derecho Educativo y Derecho a la Educación de
formas indistintas, aunque refieran a dos categorías jurídicas diferentes.
En ese artículo, se pretende abordar las diferencias básicas entre ambas
nociones, a partir de los postulados de la normativa, la jurisprudencia y
la doctrina.
Due to its emergence within academic forums, the conceptualization of Education Law still presents terminological ambivalences that hinder its technical understanding. Sometimes the terms Education Law and Right to Education are used interchangeably, although they refer to two different legal aspects. This article aims to address the basic differences between both grounded on the assumptions of regulations, jurisprudence and legal doctrine.
